Delivery, Returns and Cancellations

1. Who we are?

1.1. We are Taira Technology Limited, a limited company registered in England and Wales with company number 10882724 and whose registered office is at Suite 23, Fifth Floor, 63/66 Hatton Garden, London, EC1N 8LE.

1.2. We provide products and services to visually impaired individuals that live with different levels of sight loss.

2. When this policy applies

2.1. This Cancellation and Refunds Policy applies whenever you purchase our products and services under a Contract made in accordance with our Terms and Conditions of Sale.

2.2. For the avoidance of doubt, this Cancellation and Refunds Policy forms part of the Contract and is incorporated in it by reference.

2.3. Unless otherwise defined in this Cancellation and Refunds Policy, defined terms shall have the meaning given to them in the Terms and Conditions of Sale.

3. Cancellation of your Account

3.1. You can cancel your Account at any time. If you want to delete your Account, please contact us via telephone on 03432897501, or via email using our contact form.

3.2. If the cancelation of your Account results in the cancellation of purchases of products and services under a Contract, the remainder clauses of this Cancellation and Refunds Policy shall apply to any such purchases cancelled as a result of the cancellation of your Account.

3.3. Upon cancellation of your Account, you will be automatically removed from our mailing lists, but we may retain your personal data in accordance with our Privacy Policy.

4. Your right to cancel – Products and Services – Cancellation before Confirmation

4.1. If you don’t accept the Confirmation within the deadline referred to in the Terms and Conditions of Sale, the Order will be deemed cancelled.

4.2. You may cancel your Order at any time before you send us your acceptance to the Confirmation in accordance with the Terms and Conditions of Sale. If you want to do so, please contact us via telephone on 03432897501, or via email using our contact form.

4.3. If your Order is cancelled under clauses 4.1 or 4.2, we will refund you any and all part of the Price you have paid before the cancellation of the Order.

5. Your right to cancel – Products – Cancellation before dispatching

5.1. You have the right to cancel your purchase of a product before it has been dispatched to you.

5.2. If you want to cancel your purchase of a product, please contact us via telephone on 03432897501, or via email using our contact form, and we will let you know if the product has been dispatched.

5.3. If the product has not been dispatched, we will accept your request for cancellation and will refund the Price you paid for that product.

5.4. If the product has been dispatched, we will not be able to cancel the purchase under this clause 5. If you are a consumer, you may still exercise your right to change your mind within 14 days of delivery in accordance with clause 6.

6. Your right to cancel – Products – Your right to change your mind

6.1. If you are a consumer, you can change your mind about a purchase of a product within 14 days after its delivery. If you have changed your mind about a product you purchased from us, please contact us via telephone on 03432897501, or via email using our contact form within that period.

6.2. Notwithstanding clause 6.1, you will not have the right to change your mind about a purchase of products that:

6.2.1. are sealed for health protection or hygiene purposes, once these have been unsealed after you receive them;

6.2.2. have missing labels, tags and accessories;

6.2.3. are damaged and not in the condition in which we sent them;

6.2.4. was made to your specification or are clearly personalised; and

6.2.5. become mixed inseparably with other items after their delivery.

6.3. If you exercise your right to change your mind in 14 days, we will inform you how you can return the products to us and you shall bear the costs of the return.

6.4. When we receive the returned product, we will inspect it to confirm that it is not damaged.

6.5. If the product is returned with all original accessories and isn’t damaged, we will refund the Price you paid for the returned product less any return costs we may have paid on your behalf.

6.6. If the returned product is damaged and/or if accessories are missing, we will refund the Price you paid for the returned product less any return costs we may have paid on your behalf and any repairment and replacement costs we incur to remedy the damages to the product.

7. Your right to cancel – Products – Defective Products

7.1. If you believe that a product you purchased from us is defective and/or does not comply with the Contract, please contact us via telephone on 03432897501, or via email using our contact form, and provide us with details of the defect or non-compliance.

7.2. We will instruct you how to return the product to us at our cost.

7.3. When we receive the product, we will inspect it to check if it is defective and/or non-compliant with the Contract and what is the defect and/or non-compliance.

7.4. We will endeavour to make all reasonable efforts to inform you of our assessment of the product within 14 days after we receive the product.

7.5. If the product is defective, and the defect has not been caused by your use of the product, we will, at our discretion, refund the Price you paid for the defective product, repair the defective product or replace it.

7.6. If the product does not comply with the Contract, we will at our discretion, refund the Price you paid for the non-compliant product or replace it.

7.7. If the product is not defective and/or complies with the Contract, you will not be entitled to a refund and you may request that we deliver the product again to you, provided that you pay the delivery costs.

8. Your right to cancel – Services – Your right to change your mind

8.1. If you are a consumer, you can change your mind about the services you engaged us to supply within 14 days after the Contract is formed. If you have changed your mind about services you engaged us to supply, please contact us via telephone on 03432897501, or via email using our contact form within that period.

8.2. Notwithstanding clause 8.1, you will not have the right to change your mind about services you engaged us to supply if:

8.2.1. the services have been provided to you within 14 days after the Contract was formed; or

8.2.2. the services involve the booking of sessions with us and a shorter notice period for cancellation is set out in the Confirmation.

8.3. You can change your mind about the services you engaged us to provide within the notice period (if any) set out in the Confirmation.

8.4. If you exercise your right to change your mind in accordance with clauses 8.1 or 8.3, we will refund you the price you paid for the services.

9. Your right to cancel – Services – Other Cancellations

9.1. If you want to cancel the services you engaged us to provide outside the 14-day period after the Contract is formed (if you are a consumer) or outside the notice periods set out in the Confirmation, you can do so by contacting us via telephone on 03432897501, or via email using our contact form.

9.2. If you exercise your right to cancel the services in accordance with clause 9.1:

9.2.1. we will refund you for the Price paid for any services that have been paid for but have not been supplied;

9.2.2. we reserve the right to charge you a cancellation fee that will reflect our losses, costs and expenses as a result of that cancellation; and

9.2.3. we shall have the right to deduct from any refund due under clause 9.2.1 any cancellation fee due under clause 9.2.2.

10. Your right to cancel – Services – Defective Services

10.1. If you believe that the services we provided to you are defective and/or do not comply with the Contract, please contact us via telephone on 03432897501, or via email using our contact form and provide us with details of the defect or non-compliance.

10.2. We will endeavour to make all reasonable efforts to inform you of our assessment of the services within 14 days after we receive your request.

10.3. If the services were defective or non-compliant with the Contract, we will, at our discretion, repeat or fix the services or refund you the Price you paid for them.

11. Our right to cancel – Products and Services

11.1. If for any reason we are no longer able to supply the products or the services, we can terminate the Contract. If we intend to do so we will notify you.

11.2. If we terminate the Contract under clause 11.1, we will refund you the part of the Price that relates to the products and services that will no longer be supplied to you.

11.3. For the avoidance of doubt, we will not be required to refund you for products and services that have already been delivered before we notify you that we intend to terminate the Contract.

12. Refunds

12.1. Any refunds due to you in accordance with this Cancellation and Refunds Policy will be processed via the same payment method used when you made payment.

12.2. We will endeavour to make all reasonable efforts to process any refund due to you within 14 days after we confirm that you are entitled to a refund.
