Delivery, Returns and Cancellations

OUR DELIVERY POLICY

All orders you place will be despatched via royal mail or DPD and will usually reach you within 7 working days. Bespoke products may take longer to arrive. When placing your order, we will advise you of the service we are using to send your parcel. You will receive an automated email from our systems when your order has been despatched. Taira Technology complies with all trading legislation covering consumer protection, distance selling and electronic commerce regulations. Therefore, you have the right to cancel your order before we have despatched the goods or within fourteen days of receipt. Once we have received the items back in their original condition we will refund you within 14 working days. There are exceptions to returning some items, so please carefully check the full description of the product to check any special conditions that may apply.

OUR RETURNS POLICY

THIS RETURNS POLICY APPLIES ONLY TO CONSUMERS

1.1 By law, we must provide Products that are of satisfactory quality, fit for purpose and that match any samples or models that you have seen or examined (unless we have made you aware of any differences). These rules also apply to any digital content contained within the Product.

1.2 If any Product you have bought from us does not comply, please contact us within 30 days as soon as reasonably possible to tell us about the problem, and to arrange for a refund, repair or replacement.

1.3 You have the following rights:

1.3.1 Beginning on the day that you receive the Product you have 30 calendar days to reject the Product and to receive a full refund if the Product does not conform or is not suitable.

1.3.2 If you do not wish to reject the Product, or if the 30 calendar day rejection period has expired and the Product develops a fault, you may ask us to repair the Product or provide a replacement. We will pay all costs and will carry out the repair or replacement within a reasonable time and without significant inconvenience to you.

1.3.3 If repair or replacement is impossible or otherwise disproportionate, we may, instead, offer you the alternative of a replacement or a full refund.

1.3.4 If you request a repair or replacement during the 30 calendar day rejection period, that period will be suspended while we carry out the repair or replacement and will resume on the day that you receive the replacement or repaired goods. If less than 7 calendar days remain out of the original period, it will be extended to 7 calendar days.

1.3.5 If, after a repair or replacement, the Product still does not conform (or if we cannot repair it, or have failed to act within a reasonable time or without significant inconvenience to you), you may have the right either to keep the Product, at a reduced price, or to reject it in exchange for a refund. Such a refund may REFLECT the use you have made of the product.

1.3.6 If you exercise the final right to reject the goods more than six months after you have received the Product, we may reduce any refund to reflect the use that you have had out of the product.

1.4 The above rights will not apply if:

1.4.1 we told you about the fault(s), damage or other problems with the Product before your purchase; or

1.4.2 if the use you want to make of the Product is not the use it was designed for; or

1.4.3 if the problem is the result of normal wear and tear, misuse or intentional or careless damage.

1.5 To return a Product to us for any reason under this Returns Policy, please contact us to arrange for a collection or return. We will take full responsibility for the costs of returning the Product providing you follow the instructions we have given you for the return. Please note that we only cover return costs if the product is defective, not fit for purpose or not as described – you must pay the postage for all other returns. If you do not have sufficient proof of posting (we suggest that you use a tracked service) we cannot be held responsible if we do not receive the product.

1.6 Any refund will be paid to you, using the same method by which you paid us and within 14 days of our offering that refund.

CANCELLATION POLICY

RIGHT TO CANCEL (CONSUMERS)

1. The following rights apply only to consumers. They do not apply if you are a business or buying Products or Services for a business and for the purposes of these Terms a charity or fundraising institution is treated as a business.

2. You may have the right to cancel this contract within 14 days without giving any reason.

3. The 14-day period will start:

3.1 If the item we are selling is a physical item – when you receive it.

3.2 If we are supplying multiple Products – then the day upon which you received the last item.

3.3 If this is a regular supply – when you receive the first consignment.

4. CANCELLATION

4.1 To exercise your right to cancel, you must tell us by telephone or email that you wish to return the item you have purchased. It helps if you contact us before making any return so we can register your return on our system.

4.2 To meet the cancellation deadline, you must tell us before the end of the 14-day period from the date you receive the item. You should keep a proof of posting when sending a Product back to us.

4.3 When returning a product, you must make sure that your name is on the parcel. If you send a parcel that does not have your name clearly shown, an admin charge will be applied to your return as we then need to trace the sender of the parcel.

5. EFFECT OF CANCELLATION

5.1 If you cancel this contract, we will repay you all payments you have made to us, including delivery costs (unless you have asked for non-standard delivery).

5.2 We can deduct from the amount we send back to you any reduction in value of the Product which results from unnecessary handling by you.

5.3 We will repay you:

5.3.1 Within 14 days from receiving the Product back from you.

5.3.2 Within 14 days of receiving proof that you sent the Product back to us.

5.3.3 If we have not yet supplied the Product, then within 14 days of your telling us that you want to cancel.

6. We will pay you back using the same method that you paid us.

7. If you have removed labels and tags from the Product, if you have damaged the Product or if you return the Product in an unsaleable condition, your rights to cancel your purchase or request a refund may be affected.

RETURNS AND CANCELLATIONS (BUSINESSES)

1.1 If on delivery any Product we supply is defective in any material respect and either you, lawfully, refuse delivery of the defective Product, or if the Product is signed for on delivery as “condition and contents unknown”, you must give us written notice of the defect within 4 days of the delivery. We may, at our discretion:

1.1.1 replace the defective Product within 28 days of receiving the Product back from you; or

1.1.2 refund to you the price for that Product (or parts thereof, as appropriate) which are defective,

and we will have no further liability to you in respect of any defects and you may not reject any Product if delivery is not refused or notice given by you, as set out above.

1.2 No Product may be returned to us without our prior written agreement and your compliance with our instructions on the means of returning the Product to us.

1.3 We will be under no liability in respect of any defect arising from fair wear and tear, or any wilful damage, negligence, subjection to normal conditions, failure to follow our instructions (whether given orally or in writing), misuse or alteration of the Product without our prior approval, or any other act or omission on your part, or on the part of your employees or agents or any third party.

1.4 If we find that there is no defect in a Product which is returned to us, we will return it to you on receipt of the costs of delivery and correct delivery instructions.

1.5 Goods, other than defective goods returned under Sub-clause 1.1, returned by you and accepted by us may be credited to you at our sole discretion and without any obligation on our part.

1.6 Subject as expressly provided in these Terms, and except where the Product is sold under a consumer sale, all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

1.7 You are responsible for ensuring that:

1.7.1 except to the extent that instructions as to the use or sale of the Product are contained in the packaging or labelling of the Product, any use or sale of the Product by the Customer is in compliance with all applicable statutory requirements; and

1.7.2 that handling and sale of the Product by you is carried out in accordance with directions given by us or any competent governmental or regulatory authority and you will indemnify us against any liability loss or damage which we might suffer as a result of your failure to comply with this condition.
